The issues of the present suit are disposed of in Trice v. Simon, 233 So.2d 609, a [612]*612companion appeal rendered by us this date. For the reasons stated in the companion appeal, the motion to dismiss the appeal is granted, at appellant’s cost.

Appeal dismissed.
