Shipman, an attorney, as it is claimed, was obtained by trick, affirmed, without costs. The claimants may proceed in the Surrogate’s Court, where the issues of fact may be tried. Ho opinion. Lazansky, P. J., Young, Hagarty, Carswell and Davis, JJ., concur.
