Opinion

In a proceeding to construe a will, decree of the Surrogate’s Court, Putnam County, as resettled, decreeing, among other things, that the legacy given by the “ Tenth ” paragraph of the will is valid, unanimously affirmed, with costs to all parties filing briefs, payable out of the estate. No opinion. Present — Lazansky, P. J., Hagarty, Carswell, Johnston and Adel, JJ.
