OPINION OF THE COURT

On the Court’s own motion, it is determined that Honorable Fred Cleveland is suspended, with pay, effective immediately, from his office of Town Justice of the Town of Kortright, Delaware County, pursuant to NY Constitution, article VI, § 22 (f), (g) and Judiciary Law § 44 (8) (b), (c).

Concur: Chief Judge Kaye and Judges Simons, Titone, Bellacosa, Levine and Ciparick. Taking no part: Judge Smith.
