Mount Vernon Trust Co. v. Millard, 127 [912]*912id. 77; People ex rel. Wilson v. African W. M. E. Church, 156 id. 386.) Jenks, P. J., Putnam, Blackmar, Kelly and Jaycox, JJ., concurred.
