The following opinion was filed January 8, 1901:
The principles governing this case are identical with those which rule Illinois S. Co. v. Bitot, ante, p. 418. The same errors exist in this case which necessitate a reversal of the judgment in that case, and it is ruled accordingly.
By the Oourt.— The judgment of the superior court is reversed, and the cause remanded for a new trial.
A motion for a rehearing was denied March 19,1901.
