COVINGTON, Judge:

For the reasons assigned in the case of “Toomer Electrical Company, Inc. v. Humble Oil and Refining Company et al.”, 321 So.2d 827, the judgment of the trial court is affirmed, dismissing plaintiff’s suit at its costs.

Affirmed.
