20 IT IS HEREBY STIPULATED by and between the parties, through their undersigned 21 attorneys, and with the approval of the Court, that this matter be remanded on an open record for 22 further administrative proceedings, pursuant to sentence four of 42 U.S.C. § 405(g). On remand, the 23 Appeals Council should instruct the administrative law judge to Further develop the record, as 24 necessary; offer the claimant the opportunity for another administrative hearing ; reevaluate the 25 evidence, including the medical opinion of Mirit Avram, M.D.; and issue a new decision. 1 The parties further request that the Clerk of the Court be directed to enter a final judgment in 2 favor of Plaintiff, and against Defendant, reversing the final decision of the Commissioner. Remand 3 should be made under sentence four of 42 U.S.C. § 405(g). See Melkonyan v. Sullivan, 501 U.S. 89 4 (1991). Upon proper presentation, the Court will consider Plaintiffs application for reasonable 5 attorney fees and expenses pursuant to 28 U.S.C. § 2412(d) and costs as enumerated in 28 U.S.C. 6 § 1920, under 28 U.S.C. § 2412(a).
