White, J.

The facts in this case are substantially the same as those in the case of Daniel W. Moore against the same [30]*30defendant, the plaintiff having "been injured hy the same accident, and it is agreed by the parties that the decision in that case shall govern this one, and so the judgment and order appealed from should be affirmed, with costs.
