Motion for reargument granted, without costs, and, upon reargument, the decision dated October 28, 1969 [33 A D 2d 630] and the order entered November 6, 1969 are amended to provide that respondent’s determination is modified, pursuant to CPLR 7803 (subd. 3), to direct that petitioner’s license be suspended for one year, and, as so modified, confirmed, without costs. Herlihy, P. J., Reynolds, Staley, Jr., Greenblott and Cooke, JJ., concur.'
