Opinion
The facts of this case, in regard to the consideration of the contract sued on, are identical with those in the case of James W. Howard v. Joshua E. Kirwin, and for the reasons for our judgment in that case just decided.
It is ordered, adjudged and decreed, that the suit he dismissed at the posts pf the appellant.
