Opinion

In a negligence action to recover damages for personal injuries, plaintiffs appeal from a judgment of the Supreme Court, Suffolk County, entered June 17, 1974, in favor of defendant, upon a jury verdict. Judgment reversed, on the facts, and new trial granted, with costs to abide the event. The verdict was contrary to the weight of the credible evidence. Gulotta, P. J., Latham, Cohalan and Shapiro, JJ., concur; Martuscello, J., dissents and votes to affirm the judgment.
