Opinion

M’Girk, C. J.,

delivered the opinion of the Court.

The sole question made in this cause is, whether hail can surrender the principal where a sci. fa. is issued, and before it is returned executed. The statute is definite on this point, the surrender was in time, and the Court did right in discharging the .bail.

The judgment is affirmed, with costs.
