The decision of this court handed down on April 13, 1934 [ante, p. 821], is hereby amended to read as follows: Order, in so far as it denies the motion to dismiss the amended complaint, affirmed, with ten dollars costs and disbursements, with leave to appellant to answer within ten days from the entry of the order herein. No opinion. Lazansky, P. J., Young, Kapper, Hagarty and Davis, JJ., concur.
