Opinion

Lore, C. J.:

In the case of The Home Loan Association vs. Foard, d. al., we have carefully considered the application to open the judgment, because of what seemed to be a hardship. And after the most thorough consideration, the Court have reached the conclusion that the application is not within the statute and that it would be establishing a bad precedent for us to open this judgment. We are therefore compelled to refuse the application.
