Opinion

Action to recover damages for breach of a contract of employment wherein defendant agreed to pay a specified percentage of net profits on a specified type of work. Defendant appeals from an order granting plaintiff’s motion for discovery and inspection of certain specified books and records of the defendant. Order affirmed, with $10 costs and disbursements, the examination to proceed on five days’ notice. Ha opinion. Hagarty, Acting P. J., Cars-well, Adel and Holán, JJ., concur.
