Judgment reversed on the law and facts, with costs, and complaint dismissed, with costs, on the ground that the plaintiff failed to establish negligence on the part of the defendant. (See Miller v. Gimbel Bros., Ine., 262 H. V. 107.) All concur, Vaughan, J., not voting. (The judgment appealed from is for plaintiff in a negligence action.) Present — Taylor, P.
