Opinion

The Court-

were of opinion that the evidence in this cause did not support the charge of fraud ; that the plaintiff, having a demand against John Drew, had a right to take this land in security; and that he took it subject only to be defeated by redemption, which could only be by the payment of [107]*107principal and interest in money ; that a relevy was not a redemption, and consequently that the plaintiff was entitled to recover.

The jury were of that opinion, and found the defendant guilty,
