1 UNITED STATES DISTRICT COURT 2 DISTRICT OF NEVADA 3 Tony Hobson, 2:22-cv-02088-JAD-MD 4 Plaintiff(s), ORDER GRANTING MOTION 5 vs. 6 CO Harper, et al., 7 Defendant(s). 8 Pending before the Court is pro se plaintiff Tony Hobson’s Motion to Serve Last Two 9 Defendants (“Motion”) (ECF No. 53). For good cause shown and because it is unopposed, the Court 10 GRANTS the Motion. 11 The Court previously granted plaintiff’s Motion for Service (ECF No. 46). The Order required 12 plaintiff to complete a USM-285 form for each defendant and furnish the forms to the US Marshals. 13 Plaintiff states that he never received the USM-285 forms. The unexecuted summons (ECF Nos. 51, 52) 14 also reflects this. Thus, there is good cause to grant the Motion. 15 16 ACCORDINGLY, 17 IT IS ORDERED that the Motion to Serve the Last Two Defendants (ECF No. 53) is 18 GRANTED: 19 1. The Clerk of Court is directed to send to plaintiff two copies of the USM-285 forms. 20 2. Plaintiff has 20 days within which to furnish to the U.S. Marshal the required USM-285 21 forms and return it to the U.S. Marshal, 333 Las Vegas Blvd. South, Suite 2058, Las Vegas, NV 89101. 22 23 3. Within 20 days after plaintiff receives a copy of the completed USM-285 forms from the U.S. Marshal, plaintiff must file a notice with the Court stating if defendant(s) was served. 24 25 4. If Plaintiff wishes to have service again attempted on an unserved defendant, a motion must be filed with the Court identifying the unserved defendant and specifying a more detailed 2 name and/or address for said defendant, or whether some other manner of service should be 3 attempted. 4 5. The Clerk of Court shall issue summonses for defendants (1) Amir Boone and (2) Jesus Ruiz, 5 and deliver the same, to the U.S. Marshal with the address provided under seal at ECF No. 29. 6 6.
