By the Court:

This cafe must be governed by the law as it stood when the descent was cast. The statute passed at the revision of the laws in the year 1784 can have no retrospect to cases which happened before. By the construction usually given to the statute before the revision, the mother was next of kin and ought to succeed as heir to the son in exclusion of uncles and aunts.
