Affirming.

This controversy rélates to the ownership of a small body of land, containing 3.3 acres. The controversy arose from the following facts and circumstances. In 1890, in a suit for the settlement of the estate of George Winston, deceased, certain lands, belonging to the estate of the decedent, were ordered to be sold under a judgment of the Kenton circuit court. The lands were ordered to be sold in lots, and it seems, that prior to the sale, they had been divided into lots and plats made, .showing the boundaries and quantity of land contained in the respective lots.
