PETITION FOR WRIT OF HABEAS CORPUS, AND DIRECTING CLERK OF 14 WARDEN, FCI-MENDOTA, COURT TO ENTER JUDGMENT 15 Respondent. [Doc. 12] 16 17 Petitioner is a federal prisoner proceeding pro se and in forma pauperis with a petition for 18 writ of habeas corpus pursuant to 28 U.S.C. § 2241. Both parties consented to the jurisdiction of 19 the Magistrate Judge, on January 30, 2023, and the case was assigned to the undersigned for all 20 further proceedings pursuant to 28 U.S.C. § 636(c)(1). (Docs. 4, 5, 8, 9.) 21 On December 13, 2022, Petitioner filed the instant habeas petition. (Doc. 1.) On March 22 15, 2023, Respondent filed a motion to dismiss the petition. (Doc. 12.) Respondent contends the 23 petition should be dismissed for mootness, failure to exhaust, and lack of jurisdiction. (Doc. 12.) 24 Petitioner did not file an opposition. Having reviewed the pleadings, and in light of recent 25 changes in BOP procedures, the Court will GRANT Respondent’s motion to dismiss and 26 DISMISS the petition. 27 ///// 28 ///// 1 DISCUSSION 2 I. Motion to Dismiss 3 The Ninth Circuit has allowed respondents to file a motion to dismiss in lieu of an answer. 4 See, e.g., O’Bremski v. Maass, 915 F.2d 418, 420 (9th Cir. 1990) (using Rule 4 to evaluate 5 motion to dismiss petition for failure to exhaust state remedies); White v. Lewis, 874 F.2d 599, 6 602-03 (9th Cir. 1989) (using Rule 4 as procedural grounds to review motion to dismiss for state 7 procedural default); Hillery v. Pulley, 533 F.Supp. 1189, 1194 & n.12 (E.D. Cal. 1982) (same). 8 The Court will review the motion under Rule 4 standards. See Hillery, 533 F. Supp. at 1194 & n. 9 12. 10 II. Background 11 Petitioner is serving a 70-month term of imprisonment for his conviction of possessing 12 with intent to distribute over five (5) kilograms of cocaine in violation of 21 U.S.C. §§ 841(a)(1), 13 841(b)(1)(A). (Doc. 12-1 at 2-9.1) 14 Petitioner is incarcerated at Federal Correctional Institution in Mendota, California. In his 15 petition, Petitioner claims that the Bureau of Prisons (“BOP”) determined him ineligible for First 16 Step Act (“FSA”) credits because he is a deportable alien. (Doc. 1 at 12-13.) Since then, BOP 17 records indicate that Petitioner has been awarded 190 days of FSA credits toward early transfer to 18 supervised release, and he has an advanced FSA projected release date of November 15, 2024. 19 (Doc. 12-1 at 31.) 20 According to the BOP’s records of its Administrative Remedy Program, Petitioner has not 21 submitted an Administrative Remedy Request. (Doc. 12-1 at 11-12, 27.) 22 III. The First Step Act 23 The First Step Act was enacted on December 21, 2018, and implemented a number of 24 prison and sentencing reforms, including computation of good time credits, reducing and 25 restricting mandatory minimum sentences, safety valve eligibility, retroactive application of the 26 Fair Sentencing Act, and the availability of early release. 4 [P]aragraph 102(b)(1) amends [18 U.S.C.] § 3624 by adding subsection (g), which is relevant to the Act's creation of an earned time credit system. [132 Stat.] at 5 5210-13. The Act requires that, within 210 days of its enactment, the Attorney General establish a “risk and needs assessment system” to, broadly speaking, 6 review each prisoner's recidivism risk level, award earned time credit as an incentive for participation in recidivism reduction programming, and “determine 7 when a prisoner is ready to transfer into prerelease custody or supervised release in accordance with section 3624.” § 101(a), 132 Stat. at 5196– 97. Section 3624(g) 8 details the criteria for when a prisoner becomes eligible, considering earned time credit, for transfer to prerelease custody or supervised release. § 102(b), 132 Stat. 9 at 5210–13. 10 Bottinelli v. 19 (1) In general.--Not later than 180 days after the Attorney General completes and releases the risk and needs assessment system (referred to in this subsection as the 20 “System”) developed under subchapter D, the Director of the Bureau of Prisons shall, in accordance with that subchapter-- 21 (A) implement and complete the initial intake risk and needs assessment 22 for each prisoner (including for each prisoner who was a prisoner prior to the effective date of this subsection), regardless of the prisoner's length of 23 imposed term of imprisonment, and begin to assign prisoners to appropriate evidence-based recidivism reduction programs based on that determination; 24 (B) begin to expand the effective evidence-based recidivism reduction 25 programs and productive activities it offers and add any new evidence- based recidivism reduction programs and productive activities necessary to 26 effectively implement the System; and

27 (C) begin to implement the other risk and needs assessment tools necessary to effectively implement the System over time, while prisoners are 28 participating in and completing the effective evidence-based recidivism 1 reduction programs and productive activities.

2 (2) Phase-in.--In order to carry out paragraph (1), so that every prisoner has the opportunity to participate in and complete the type and amount of evidence-based 3 recidivism reduction programs or productive activities they need, and be reassessed for recidivism risk as necessary to effectively implement the System, 4 the Bureau of Prisons shall--

5 (A) provide such evidence-based recidivism reduction programs and productive activities for all prisoners before the date that is 2 years after the 6 date on which the Bureau of Prisons completes a risk and needs assessment for each prisoner under paragraph (1)(A); and 7 (B) develop and validate the risk and needs assessment tool to be used in 8 the reassessments of risk of recidivism, while prisoners are participating in and completing evidence-based recidivism reduction programs and 9 productive activities. 10 18 U.S.C. § 3621(h)(1)–(2). 11 Pursuant to 18 U.S.C.
