Opinion

Order reversed on the law, with ten dollars costs and disbursements, and plaintiff’s motion for summary judgment granted, with ten dollars costs. In our opinion, respondent’s answer to the amended complaint is sham and false and states no defense to the plaintiff’s cause of action. Lazansky, P. J., Young, Carswell, Scudder and Tompkins, JJ., concur.
