Opinion

Per Curiam.

The petition with the amendment thereto set forth a cause of action as against the demurrer filed by the defendant, and the court erred in dismissing the same.

Judgment reversed.

All the Justices concur, except Fish, O. J., absent. W. U. Payne, for plaintiff. Watkins & Watkins and B. M. W. Glenn, for defendant.
