JOINT MOTION TO VACATE AND REMAND AND TO EXPEDITE MANDATE PURSUANT TO SETTLEMENT

TO THE HONORABLE COURT OF APPEALS:

This Court abated the appeal on January 30, 2025. Since then, Appellant

Harbor America Central, Inc., and Appellee William Reeves have finalized their

settlement agreement.

Under Texas Rule of Appellate Procedure 42.1(a)(2), the parties on both sides

ask this Court to reinstate the appeal, set aside the trial court’s judgment without

regard to the merits, and remand the case to the trial court for rendition of a take-

nothing judgment in accordance with the parties’ agreement.

Further, under Texas Rule of Appellate Procedure 18.1(c), the parties

respectfully request that the Court issue its mandate immediately so the parties may

move forward expeditiously with their settlement in the trial court. Respectfully submitted,
