Opinion

O’CONNELL, J.

This is an action for damages for breach of contract for the sale to the plaintiffs of a farm owned by [161]*161defendant. At the conclusion of plaintiffs’ case the trial court, upon motion of the defendant for an involuntary nonsuit, granted judgment for defendant.

The question presented for decision on appeal is whether the writings offered in evidence by plaintiffs constituted a “note or memorandum” as required by the Statute of Frauds (CBS 41.580 (5)).
