Chief Justice.

Handlong and wife sued Barnes, in ejectment, for lands which they alleged were the property of Mrs. Handlong, as heir-at-law of her father. At the trial, Barnes was offered as a witness and rejected. The point to be decided is, was he a competent witness ?
