Defendants have appealed from an order of the Montgomery Special Term of Supreme Court denying their motions for judgment on the pleadings and for summary judgment. Issues of fact are involved and the Special Term properly denied the motions. Order unanimously affirmed, with $10 costs and printing disbursements. Present -— Foster, P. J., Heffernan, Brewster, Deyo and Coon, JJ.
