Opinion

Stiles, J.

The notice of appeal in this proceeding was given in open court June 4, 1894, and it appearing that the appeal bond was not filed until June 16, the appeal became ineffectual, this court has no jurisdiction to entertain it, and it must be dismissed. Judgment for costs only against the intervenors Cass and Leuders, the respondent having accepted a voluntary dismissal as to the only other appellant, Rosa Von K. Grünewald.
