Opinion

Hill, C. J.

The allegations of the petition determine the character of the suit, and not what it is called hy the plaintiff. The allegations of the petition in the present case clearly show that the suit is one in assumpsit for money had and received. The amount involved is less than $50, and the city court of Moultrie is without jurisdiction. Acts of 1903, p. 150, section 1. Judgment affirmed.
