Opinion

PER CURIAM.

We affirm the original order of dismissal but reverse that portion which is with prejudice.

In our view plaintiff should have been permitted the opportunity to amend his complaint.

On remand the court is directed to permit the plaintiff to amend one final occasion, including such allegations as he believes to exist which would justify further litigation between these parties in Florida.

DOWNEY, ANSTEAD and GLICKSTEIN, JJ., concur.
