Opinion

Order granting defendant’s motion to dismiss complaint and for judgment on the pleadings reversed upon the law, with ten dollars costs and disbursements, and motion denied, with ten dollars costs. In our opinion the complaint sufficiently states a cause of action for malicious prosecution. Lazansky, P. J., Young, Hagarty, Carswell and Tompldns, JJ., concur.
