Considering tbe appellee’s motion, tbe pleadings and tbe testimony of -witnesses as to tbe execution of tbe judgment, and it not appearing from tbe testimony of the defendant or elsewhere in tbe record that when tbe judgment was rendered tbe water-closet and cistern to which tbe motion refers existed, tbe motion is overruled.
