Goldman v. Commonwealth

174 N.E.2d 763, 342 Mass. 779, 1961 Mass. LEXIS 866
Massachusetts Supreme Judicial Court·Decided April 27, 1961·Published

Opinion

Petition dismissed. This is a petition for a writ of error to review the same order of contempt considered in Nickerson v. Dowd, decided this day, ante, 462. The parties agree that appeal, and not writ of error, is the proper remedy. Since this petition, as stated in the petitioner’s brief, was brought only as a precautionary measure, and since the subject matter has been disposed of in the other case, this petition should be dismissed.
