Opinion

Wade, J.

1. There was ample evidence to authorize the conviction of the defendant, and the alleged newly discovered evidence is not only cumulative and impeaching in character, but would probably not produce any different result on another trial.

2. There is no merit in the various assignments of error, and the court did not err in overruling the motion for a new trial.

Judgment affirmed.

Russell, O. J., dissents.
