Opinion

Action to set aside a contract for the installation of machinery, a mortgage on realty given to secure payment of moneys to become due under said contract, the foreclosure of said mortgage, and for other relief. Order granting defendants’ motion to dismiss the complaint under rule 107, Rules of Civil Practice, and the judgment entered thereon, unanimously affirmed, with ten dollars costs and disbursements. No opinion. Present — Lazansky, P. J., Hagarty, Johnston, Adel and Close, JJ.
