Brown, J.

This action is brought to recover the possession of two small pieces of land in the city of Brooklyn. It was tried at the Kings circuit, in November, 1859, before Mr. Justice Emott, without a jury, who rendered judgment for the defendant. In respect to the piece of land secondly described in the complaint, the defendant made [375]*375no claim of Ms title, and the proof as to possession being contradictory, the court found that fact in favor of the defendant, and thus concludes all future inquiry in regard thereto. The real question arises upon the plaintiff’s title to the piece of land first described in the complaint.
