Order, entered on May 5, 1964, denying defendant’s motion to vacate plaintiff’s notice for a physical examination of plaintiff, unanimously affirmed, with $20 costs and disbursements to respondent. (See 3 Weinstein-Korn-Miller, N. Y. Civ. Prac., par. 3121.04.) Settle order on notice fixing date for examination to proceed. Concur — Breitel, J. P., Rabin, Valente, Stevens and Staley, JJ.
