Order denying plaintiff’s motion to strike out the affirmative defense pursuant to Civil Practice Rule 109, and to grant judgment on the pleadings pursuant to Civil Practice Rule 112, affirmed, with ten dollars costs and disbursements. No opinion. Lazansky, P. J., Hagarty, Carswell, Johnston and Close, JJ., concur.
