On Motion for Review
We treat the motion filed by Ainslee R. Ferdie as a motion for review of an attorney’s fee order under Florida Rule of Appellate Procedure 9.400(c). As Mr. Ferdie was counsel in the lawsuit, not a party, attorney’s fees could not be awarded against him under section 448.08, Florida Statutes (2001). See also id. § 59.46.
Reversed.
We need not address Ms. Gilleland’s status in the appeal, as that is immaterial to the issue [998]*998now before us.
