Opinion

The action is to recover a commission by a real estate broker who alleges he was the procuring cause of the sale of real property under a contract of employment with the vendor. The appeal is from an order of the County Court of Westchester county reversing, on appeal, a judgment for plaintiff, entered after trial before a jury at the City Court of New Rochelle, and directing a new trial. Order unanimously affirmed, with costs. No opinion. Present — Hagarty, Johnson, Adel, Taylor and Close, JJ.
