This action was brought for the breach of an alleged contract to hire the plaintiff as a correspondent in defendant’s bankruptcy department from month to month at a salary of $90 a month. The plaintiff claimed to have been hired about October 15, 1912, and he [322]*322was discharged on April 4, 1913. The answer denied the material allegations of the complaint.
Judgment reversed, and a new trial granted, with costs to the appellant to abide the event All concur.
