Opinion

— Appeal from an order of the Supreme Court, Erie County (Donna M. Siwek, J.), entered [1220]*1220August 24, 2007. The order granted the motion of third-party-defendants to dismiss the third-party complaint and to quash the subpoenas served upon them in the matrimonial action.

It is hereby ordered that the order so appealed from is unanimously affirmed without costs. Present — Scudder, EJ., Hurlbutt, Fahey, Peradotto and Pine, JJ.
