Judgment affirmed, with costs. Memorandum: Our decision rests on the determination of the Court of Appeals in Johnson v. Meyer (242 App. Div. 798; affd., 268 N. Y. 701). All concur. (The judgment awards damages in an action upon a bond to recover interest and taxes paid to protect the lien of plaintiff’s mortgage.) Present — Sears, P. J., Taylor, Edgeomb, Crosby and Lewis, JJ.
