TO THE HONORABLE COURT OF CRIMINAL APPEALS:

Comes now the State of Texas, by and through its State Prosecuting Attorney, and respectfully urges this Court to grant discretionary review of the above named cause, pursuant to the rules of appellate procedure.

STATEMENT REGARDING ORAL ARGUMENT The State requests oral argument. The statute at issue has remained largely unchanged since 1947 but has yet to be interpreted by this Court. It is a common basis for traffic stops, and its treatment by many courts of appeals is illustrative of a pattern of ignoring the plain language of Transportation Code offenses.1
