Opinion

Luke, J.

This case is controlled adversely to the contentions of the plaintiff in error by the law as laid down in Covington v. Rosenbusch, 148 Ca. 459 (97 S. E. 78); and the judge of the superior court did not err in overruling the certiorari.

Judgment affirmed.

Broyles, C. J., and Bloodworth, J., conmir.
