Opinion

Edw ards, Ch. J.

delivered the opinion of the court. After a statement of the case, he proceeded:

It is evident, from the record, that there were four parties to the submission; and that four distinct claims. [323]*323one belonging to each party, were submitted; and the arbitrators, In their award, have accordingly awarded upon the respective claims of each party severally. It will, therefore, be necessary to consider so much of the award as relates to the plaintiffs in this writ of error, and their interest only.

We will examine the errors assigned, in their order.

By an act of assembly, passed March 1st 1797
