PER CURIAM.

The petition is den-ied on the authority of our opinion in Nicholas v. Wainwright, 152 So.2d 458, filed this date. However, the petitioner shall remain in custody subject to appropriate action of the Board of Commissioners of State Institutions as authorized by the cited decision.

It is so ordered.
