Freddie L. Walker Sr. v. Vernon Ringer, Valentine Delivery Services, LLC, Stephanie Renee Davila, and Darrell Valentine
Opinion
In The
Court of Appeals
Ninth District of Texas at Beaumont
NO. 09-25-00457-CV
FREDDIE L. WALKER SR., Appellant V.
VERNON RINGER, VALENTINE DELIVERY SERVICES, LLC, STEPHANIE RENEE DAVILA, AND DARRELL VALENTINE, Appellees
On Appeal from the 260th District Court Orange County, Texas
Trial Cause No. 250150-C
MEMORANDUM OPINION
Appellant Freddie L. Walker Sr. filed a notice of appeal and a statement of inability to afford payment of court costs. The record was duly filed, but Appellant failed to file a brief.
On May 4, 2026, we notified the parties that Walker had not filed a brief and that his appeal would be submitted without briefs unless, by May 14, 2026, he filed a motion for extension of time accompanied by a brief supporting his appeal. We
also warned Walker that his appeal could be dismissed for want of prosecution if the Court submitted the appeal without a brief.
On May 14, 2026, Walker filed a motion for extension of time, but he did not file a brief. We granted a motion for extension of time to file the brief by July 10, 2026, and we warned Walker that no further extensions would be granted except for good cause shown. To date, we have not received an Appellant’s Brief.
On July 23, 2026, Appellee Stephanie Renee Davila filed a motion to dismiss the appeal for want of prosecution. In the absence of a brief assigning error for our review, we grant Davila’s motion to dismiss. Accordingly, the appeal is dismissed for want of prosecution. See Tex. R. App. P. 38.8(a)(1); id. 42.3(b), 43.2(f).
APPEAL DISMISSED.
