ORDER DISMISSING APPEAL

A Notice of Appeal was timely filed herein. On March 26, 2010, the parties were ordered to file Briefs/Memoranda or Statements in support of their relative positions. On June 21, 2010, Appellant Fort Peck Tribes was granted a 90 day extension on the appeal due to the absence of Appellee Escarcega from the area. The extension has expired. Appellant did not file a Brief. Therefore,

IT IS HEREBY ORDERED, that the Appeal is Dismissed.
